2. ORDERS
Orders are accepted within the United Kingdom only.
All contracts are governed exclusively by English law, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
3. YOUR STATUS
By placing an order through our site, you warrant that:
- You are legally capable of entering into binding contracts
- You are at least 18 years old
- All information you provide is accurate and complete
4. HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
4.1 Contract Formation
After placing an order, you will receive an email from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted.
Your order constitutes an offer to us to buy a product. All orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an email that confirms that the product has been dispatched (“Dispatch Confirmation”).
The contract between us (“Contract”) will only be formed when we send you the Dispatch Confirmation.
4.2 Products Covered
The Contract will relate only to those products whose dispatch we have confirmed in the Dispatch Confirmation. We will not be obliged to supply any other products which may have been part of your order until the dispatch of such products has been confirmed in a separate Dispatch Confirmation.
5. CONSUMER RIGHTS
Nothing in these Terms and Conditions affects your statutory rights under UK consumer law, including:
- The Consumer Rights Act 2015
- The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013
- The Consumer Protection from Unfair Trading Regulations 2008
You have the right to:
- Receive goods that are as described, of satisfactory quality, and fit for purpose
- A 14-day cooling-off period for distance sales (subject to certain exceptions)
- Remedies for faulty goods, including repair, replacement, or refund
5.1 Product Availability
Orders are subject to the availability of products. In the event that products are or become unavailable, we will notify you by email and offer a suitable alternative or provide a full refund.
6. CANCELLATION AND RETURNS
6.1 Your Right to Cancel
If you are contracting as a consumer, you may cancel a Contract at any time within 14 days (the “cooling-off period”), beginning on the day after you received the products.
To exercise your right to cancel, you must inform us in writing by:

6.2 Return of Products
You must return the products to us as soon as reasonably practicable, and at your own cost (unless the products are faulty or misdescribed).
You have a legal obligation to take reasonable care of the products while they are in your possession. If you fail to comply with this obligation, we may have a right of action against you for compensation.
6.3 Refunds
If you cancel a Contract within the cooling-off period, you will receive a full refund of the price paid for the products within 14 days of receiving the returned goods or proof of postage (whichever is earlier).
6.4 Exceptions to the Right to Cancel
You will NOT have the right to cancel a contract for the supply of:
- Perishable goods: Fresh, frozen, or chilled food, vegetables, fruits, leaves (keerai), flowers, garlands, meat, fish, dairy products
- Sealed goods opened by you: Personal care products, cosmetics, hygiene products, or any sealed items unsuitable for return due to health protection or hygiene reasons once unsealed
- Personalized or bespoke products: Made to your specifications, clearly personalized, or custom-made
- Newspapers and magazines: Periodicals (except subscription contracts)
Important: These exceptions do not affect your statutory rights for faulty or misdescribed goods.
7. PERSONALISED PRODUCTS
When ordering personalised products such as personalised banners, cards, or other custom items (“Personalised Products”), you accept full responsibility for:
- Ensuring you upload adequate quality images (where applicable)
- Completing the online order form accurately
- Checking spelling, grammar, and accuracy of all text
Important: Any text or bespoke words that you provide will be used by us in the manner and form that we receive it from you, including any deliberate or otherwise obvious spelling mistakes. We will not make any alteration to the text you provide.
A ‘proof read’ or preview is provided when creating your Personalised Products online to allow you to verify the text and design. The preview is intended as a guide only and is displayed in lower resolution for screen viewing purposes.
8. AVAILABILITY AND DELIVERY
8.1 Delivery Timeframe
Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within a reasonable time of the date of the Dispatch Confirmation, unless there are exceptional circumstances.
8.2 Delivery Address
We will deliver the products ordered to the delivery address supplied by you at checkout.
It is your responsibility to ensure the delivery address is correct and complete. We cannot be held responsible for delayed or failed deliveries due to incorrect address information.
8.3 Failed Deliveries
If you are not available to receive delivery:
- The courier will follow their standard redelivery procedures
- You may be charged for redelivery costs
- Perishable items may not be eligible for refund if delivery fails due to your unavailability
8.4 Community Basket Deliveries
Delivery of Community Basket products is managed by the individual seller. Trio Mart cannot guarantee delivery times for these products. Contact details for the seller will be provided in your order confirmation.
9. RISK AND TITLE
9.1 Risk
The products will be your responsibility from the time of delivery. This means you are responsible for any loss or damage to the products after delivery.
9.2 Title (Ownership)
Ownership of the products will only pass to you when we receive full payment of all sums due in respect of the products, including delivery charges.
10. PRICE AND PAYMENT
10.1 Price
The price of the products and our delivery charges will be as quoted on our site from time to time, except in cases of obvious error.
All prices are in UK Pounds Sterling (£) and include VAT where applicable.
10.2 VAT
Product prices include VAT at the prevailing UK rate. However, if the rate of VAT changes between the date of your order and the date of delivery, we will adjust the VAT you pay, unless you have already paid for the products in full before the change in VAT takes effect.
10.3 Price Changes
Product prices and delivery charges are liable to change at any time, but changes will not affect orders in respect of which we have already sent you a Dispatch Confirmation.
10.4 Pricing Errors
Our site contains a large number of products and it is always possible that, despite our best efforts, some products may be incorrectly priced.
We will normally verify prices as part of our dispatch procedures so that:
- If the correct price is lower than our stated price, we will charge the lower amount when dispatching the product to you
- If the correct price is higher than the price stated on our site, we will, at our discretion, either contact you for instructions before dispatching the product, or reject your order and notify you
Obvious Errors: If the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as an error, we do not have to provide the products to you at the incorrect (lower) price.
10.5 Payment Methods
Payment for all products must be by credit or debit card. We accept payment with:
- Visa
- MasterCard
- Visa Debit
- Maestro
All payments are processed securely via trusted third-party payment providers in compliance with PCI DSS standards.
10.6 Payment Terms
Payment must be made in full at the time of ordering. We may refuse or cancel orders at our discretion for suspected fraud or breach of these Terms.
11. LIMITATION OF LIABILITY
11.1 Statutory Rights Protected
Nothing in these Terms excludes or limits our liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory consumer rights under the Consumer Rights Act 2015
- Any other liability that cannot be excluded or limited under UK law
11.2 Community Basket Products
Trio Mart is not liable for the quality, safety, delivery, or compliance of products sold by third-party sellers through our Community Basket marketplace. Claims must be directed to the individual seller.
12. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by the laws of England and Wales.
Disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
However, if you are a consumer resident in Scotland or Northern Ireland, you may bring proceedings in your local courts.
13. CHANGES TO THESE TERMS
We may update these Terms and Conditions from time to time to reflect changes in law, our business practices, or new features.
Changes will be posted on this page with a new “Last Updated” date. For material changes, we will provide additional notice where required by law.
Your continued use after changes constitutes acceptance of the updated Terms.
